BMW Group Indonesia sues BYD over “M6” trademark
BMW Group Indonesia has officially spoken out regarding the lawsuit they filed against BYD Motor Indonesia. The dispute centers on the use of the name “M6”, which BMW claims as its legally registered trademark.
The lawsuit was filed by Bayerische Motoren Werke (BMW) Aktiengesellschaft (AG) at the Central Jakarta Commercial Court under case number 19/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst. The case has been officially registered since February 26, 2025.
According to Jodie O’tania, Director of Communications at BMW Group Indonesia, BMW is the rightful owner of the M6 trademark, which has long been associated with its luxury 6 Series sports cars under the high-performance BMW M sub-brand.
“Regarding the use of the M6 trademark by another party in Indonesia, BMW Group, as the rightful owner, has taken legal action to protect the identity and reputation of the BMW brand,” Jodie told indonesian media detikOto on Tuesday March 4, 2025.
She emphasized that the BMW M6 is one of BMW’s most iconic M Series models, known for its high performance, innovative technology, and exclusivity. BMW is concerned that another company using the same name could lead to confusion among consumers.
“The use of the M6 trademark by another party has the potential to create public confusion,” she added.
Jodie also stated that the M6 trademark is officially registered with the General Trademark Register at the Directorate General of Intellectual Property (DJKI) under Indonesia’s Ministry of Law and Human Rights.
“This legal action is not only about protecting BMW’s rights but also ensuring the best interests of our customers in Indonesia. BMW Group Indonesia is committed to delivering a premium and exclusive driving experience,” she explained.
Meanwhile, Luther Panjaitan, Head of PR & Government Relations at PT BYD Motor Indonesia, confirmed that BMW AG had indeed filed a lawsuit against BYD Indonesia.
“Yes, there is an ongoing legal dispute between BMW AG and BYD Indonesia at the Central Jakarta Commercial Court. Our legal division is handling the case, and we are closely monitoring its progress,” said Luther.
However, he assured that the lawsuit would not impact BYD’s business operations in Indonesia.
“This case will not affect our business in Indonesia, particularly our service quality. We are confident that a fair solution will be found for both parties,” he stated.
For reference, BYD has been using the M6 name for its electric MPV, which was launched in Indonesia in 2024. Additionally, BYD had already been using the M6 name globally since 2009for its MPV models.
The legal battle between BMW and BYD is still ongoing at the Central Jakarta Commercial Court. The final verdict will determine whether BMW secures exclusive rights to the M6 trademark in Indonesia or if BYD will be allowed to continue using the name. Stay tuned for further updates.
